DOL Announces Delay in Issuance of Prevailing Wage Determinations

All ETA Forms 9141 Should be Submitted 60 Days in Advance of Initial Recruitment Efforts

On August 8, the United States Department of Labor (DOL)'s Office of Foreign Labor Certification (OFLC) announced that the National Prevailing Wage Center (NPWC) "is currently experiencing delays in processing prevailing wage determinations as it is working to reissue certain prevailing wage determinations to comply with a court order," related to H-2B visas.

DOL has said NPWC "will have to issue approximately 4,000 supplemental prevailing wage determinations" for H-2B visas, which NPWC anticipates will be completed by October 1. In the meantime, NPWC will be delayed in issuing other prevailing wage determinations, including those needed for PERM Labor Certification. A PERM Labor Certification is part of the employment-based permanent residence process and H-1B extensions for employees who are nearing the maximum time allowed under their visa.

DOL encourages all prevailing wage requestors to submit their ETA Form 9141 at least 60 days in advance of the employer's initial recruitment efforts.
